3. A specialized residential facility for persons with disabilities may apply to the Commissioner to declare a dwelling as an SDA dwelling. (b) for dwellings registered for accommodation with more than five long-term residents, since the claimant is a participant who offers an SDA himself, the specialized provider of housing for persons with disabilities may not accommodate any resident other than the participant`s spouse or common-law partner and children. (a) has an established and explicit agreement under which residents have declared their willingness to live in accordance with common values, including the principle of mutual assistance; and (2) it sets out the conditions applicable to specialized housing for persons with disabilities. 2. The service contract must include conditions defining the rights and obligations of the specialist accommodation and the participant. A specialised accommodation provider for persons with disabilities means a registered NDIS provider whose registration includes the provision of specialised accommodation for persons with disabilities. Specialized housing for people with disabilities is accommodation for people who need specific housing solutions, including assistance in providing assistance that addresses their extreme disabilities related to functioning or very high support needs. Visitors to the community will retain their existing powers and functions in Victoria with respect to SDA residents, who are under SDA housing agreement, including initiating tours. 5. The Commissioner may require specialized providers of accommodation for persons with disabilities who apply for registration of housing to provide information, including: (1) The registration of a specialized provider of accommodation for persons with disabilities is subject to the condition that the provider: (a) basic design, which refers to housing without special design features, but with a location or other characteristics that meets the requirements. Respond to disabilities and help provide support services; 3. This Section shall not apply where the specialised accommodation undertaking for disabled persons is also the participant who receives the SDA on his or her own.
